With all this going back and forth with lawsuits since June, it would appear that all systems are now go with Brutal Legend, and that Activision and Double Fine have finally reached a settlement and become friends. But what was it they were fighting about in the first place?

Well, the main cause stems from the merger between Activision and Vivendi Games. Sierra, a part of Vivendi, was planning on publishing the game, but once Activision gave it the once-over, they found no interest in the game. This is when EA steps in and takes up Double Fine’s soon to be released game.

Activision stated it still owns the publishing rights to Brutal Legend, and don’t want the game published through EA. Bitter towards Double Fine for going to EA, their rival, for the release? It would appear that way, as Double Fine has filed a counter suit.

The people of Double Fine are pretty stating that this is a conspiracy set up by Activision to stop the release of this Brutal Legend, which is quickly growing popularity. As the COO of Double Fine, Caroline Esmurdoc has written, “Now that we’ve found a publisher and the game is getting sensational coverage, they want to stop its release.”

But it would now appear that the two companies have smoothed things over, as there was a cancellation of the judge hearing Activision’s argument. So wipe the sweat off your brow, as EA is still planning on having Brutal Legend released by Q4 of this year, Jack Black and all in toe.
